The Administrative Court of Appeal does not grant IVO permission to appeal the Administrative Court's suspension decision
On 14 February 2023, the Swedish Health and Social Care Inspectorate ("IVO") appealed the Administrative Court’s decision to suspend IVO's decision to revoke Humana Assistans AB's ("Humana Assistans") permit to conduct operations with personal assistance and other services. The Administrative Court of Appeal has today, 17 February 2023, decided not to grant IVO permission to appeal. This means that Humana Assistans can continue to operate while the legal process regarding the permit continues in court.
Humana announced on 31 January 2023 that IVO had decided to revoke Humana Assistans' permit to conduct operations. On 2 February 2023, Humana announced that Humana Assistans’ had appealed the decision to the Administrative Court of Appeal in Stockholm and filed a request for suspension. On 7 February 2023, Humana announced that the Administrative Court had granted a suspension, which means that Humana Assistans can continue to conduct operations while continuing to pursue the substantive issue in court.
On 14 February 2023, IVO appealed the suspension decision made by the Administrative Court to the Administrative Court of Appeal. The Administrative Court of Appeal has today, 17 February 2023, decided not to grant IVO permission to appeal. The suspension decision made by the Administrative Court therefore remains. IVO has the opportunity to appeal the decision regarding permission to appeal to the Supreme Administrative Court of Appeal.
Humana Assistans still consider IVO's decision incorrect, for reasons including those stated in Humana's press release on 2 February 2023. The company will continue to work for safe and secure personal assistance for all customers while continuing to pursue the case in court.
